Welcome to Crushy.ai ("Crushy," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Crushy.ai website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service or by sending you an email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service contains AI-generated content that may include mature or adult themes and is not intended for minors.

If we discover or have reason to believe that you are under 18 years of age, we will immediately terminate your account and delete all associated data.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Conduct

You agree not to use the Service to:

Generate, share, or distribute content depicting minors in any sexual or exploitative context.
Create content that promotes violence, terrorism, self-harm, or illegal activity.
Impersonate real individuals without their consent or create non-consensual deepfake content.
Harass, abuse, threaten, or intimidate other users.
Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
Use automated systems, bots, or scrapers to access the Service without our written permission.
Violate any applicable local, national, or international law or regulation.
Circumvent any content moderation, safety, or filtering mechanisms.

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending or terminating accounts, and reporting to law enforcement.

5. Content Policy

The Service allows you to interact with AI-generated characters and create AI-generated images and videos. All AI-generated content is fictional and does not represent real people or events.

User-created characters: You are responsible for the characters you create and share publicly. Characters must comply with our content guidelines and applicable laws.

AI-generated content: AI outputs may be unpredictable. We implement safety measures but cannot guarantee that all generated content will be appropriate. You are responsible for reviewing and appropriately using any content generated through the Service.

6. Credits and Payments

Certain features of the Service require credits. Credits can be purchased through supported payment methods. All credit purchases are final and non-refundable unless required by applicable law.

Credits have no monetary value outside the Service and cannot be exchanged for cash.
Unused credits do not expire as long as your account remains active.
We reserve the right to change credit pricing and the credit cost of features at any time.
If your account is terminated for violation of these Terms, you forfeit all remaining credits.

Bonus credits may be granted through promotions, referrals, or other programs at our sole discretion. We reserve the right to revoke bonus credits at any time if we determine they were obtained fraudulently.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Crushy and its licensors and is protected by copyright, trademark, and other intellectual property laws.

Your content: You retain ownership of any original content you create (such as character descriptions and prompts). By sharing content publicly on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service.

AI-generated content: AI-generated images, videos, and text produced through the Service are provided for your personal use. You may use AI-generated content in accordance with applicable law, but you acknowledge that similar content may be generated for other users.

8. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination include but are not limited to violation of these Terms, abusive behavior, or prolonged inactivity.

You may delete your account at any time through the Settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy, but we may retain certain data as required by law or for legitimate business purposes.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated content may contain inaccuracies, biases, or unintended outputs. We are not responsible for any decisions or actions taken based on AI-generated content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRUSHY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Delaware.
